Ursula Smith is a graduate of Northeastern University School of Law, Class of 2013. She is licensed to practice law in Virginia, Texas and Massachusetts. She served on active duty for 15 years as a U.S. Navy Intelligence Officer and Judge Advocate. As a JAG, she assisted hundreds of military personnel in divorce filings, separation agreements, child custody arrangements and spousal support. After leaving active duty, she worked as an Assistant United States Attorney (criminal) in the Southern District of Texas on the southern border. She then worked in civil litigation, focusing on labor and employment, class actions, commercial disputes and securities litigation. Her experience in contentious disputes allows her to candidly advise you regarding whether the stress and expense of a contested divorce are right for you, or whether you can achieve an amicable resolution to your divorce.
We are a non-traditional family law practice, offering flat fee uncontested divorce, with or without children. We offer mediation to help you get to an agreeable solution. Uncontested divorce is a divorce where the parties are generally in agreement regarding the division of property, division of assets, child custody and other matters unique to your situation.
You are eligible for divorce in Virginia if you or your spouse have lived in Virginia for six months before you file and one of you still lives in Virginia at the time you file. There are specific other caveats for armed forces/USG stationed overseas and/or aboard a ship with a homeport in Virginia. Please contact us regarding a ship that is changing homeports.
If you share minor children, there is a mandatory separation period of one year prior to filing a Complaint for Divorce in Virginia. It is possible to be considered separated while living in the same residence, as long as you do not continue a marital relationship. If you do not share minor children with your spouse, and you are able to agree on property division and sign a separation agreement, you are eligible to file for divorce after a 6-month separation period.
The UCCJEA addresses a court’s subject matter jurisdiction in child custody cases, specifically answering the question of whether a court has the power to decide a custody case in which more than one state, tribe, or territory is involved. The law specifies which court has the power to decide a custody case, not how the court should decide the case, which is governed by the jurisdiction’s general child custody laws. The UCCJEA defines the home state as “the state in which a child lived with a parent or a person acting as a parent for at least six consecutive months immediately before the commencement of a child custody proceeding.” UCCJEA, §102(7).
The UCCJEA establishes enforcement provisions for child custody orders across state and international lines to help ensure the safety of the parties and child. If you have a child custody/support order from another jurisdiction (state) and you move to Virginia with your child, you must register the out-of-state order in Virginia for Virginia to enforce the out-of-state order.
In order to enforce the Virginia Court Order against the parent who has moved out-of-state, you must register the Virginia Order in the State Court where the other parent resides. You can initiate a Child Support Enforcement Proceeding through the government entity in the new state or through a private action.
